Usually, any new divorce or custody case MUST be filed in that 'home state,' NOT the state where the parent recently arrived with the children. Also, if a parent wants to change a custody or parenting-time order, if the other parent is still in the original state, THAT is the state where a 'modification' motion must be filed and heard.It may seem strange and exotic, but the UCCJEA is REAL, and it can surprise you.
