The Supreme Court has said that no one can be held guilty on the basis of refusal to attend the test identification parade. A bench of Justice DY Chandrachud, Justice Indu Malhotra and Justice Indira Banerjee said that there is no provision in the Code of Criminal Procedure and Evidence Act of India 1872, which provides statutory basis for identification parade. The identification parade is not a concrete evidence and the court will also look at all other evidence.
